Golf N Go Inc. Release of Liability, Waiver of Claims, Assumption of Risk and Indemnity Agreement

BY SIGNING THIS DOCUMENT YOU WILL WAIVE CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE OR CLAIM COMPENSATION FOLLOWING AN ACCIDENT. PLEASE READ CAREFULLY.

This agreement is with Golf N Go Inc., its owners, directors, employees, agents, contractors and equipment suppliers (together, the "Releasees"). It covers the club at 9616 100 Street, Peace River, Alberta (the "Facility").

1. Description of risks

I understand that the activities at the Facility carry risks of injury, death and property damage. These risks include, but are not limited to:

  • Golf simulators: being hit by clubs, balls or rebounding balls. Strains, sprains and back injuries from swinging. Hitting walls, screens or other people.
  • Batting cage: being hit by pitched or batted balls or by bats. Pitching-machine malfunction. Eye, head, face and hand injuries.
  • Multi-sport activities: collisions, falls, impacts from balls or equipment, overexertion.
  • VR stations with omnidirectional treadmills: falls, trips and loss of balance, including while walking or turning on the treadmill. Harness, shoe or equipment failure. Overexertion. Motion sickness, nausea, dizziness, headache, eye strain, disorientation, or seizures (including photosensitive seizures). Hitting objects, walls or people while immersed in VR, because you cannot see your real surroundings. Risks described in Meta's health and safety warnings for Meta Quest headsets.
  • Unmanned facility: Golf N Go is an unmanned facility. Nobody is on site to supervise, give instruction or give first aid, and emergency response may be delayed. Hazards include slippery floors, equipment defects, and the actions of other users.
  • Emergency access: emergency call buttons for fire, police and ambulance are located by the front entrance.
  • Negligence: the risk that the Releasees may be negligent, including failing to protect me from these risks or failing to inspect, maintain or warn.

2. Assumption of risk

I freely accept and fully assume all of these risks, along with the possibility of personal injury, death, and property damage or loss. I will follow all posted rules, watch the VR safety video before every VR session, use the equipment only as intended, and stop at once if I feel unwell or notice a hazard.

3. Medical fitness

I confirm that I am in good health and physically fit for these activities. I have no medical condition that makes taking part unsafe, including heart conditions, epilepsy or seizure history, pregnancy, or recent injury, unless a doctor has cleared me. I am responsible for my own medical costs. I allow emergency medical treatment to be arranged for me if needed.

4. Release and waiver

In consideration of being allowed to use the Facility, I WAIVE ANY AND ALL CLAIMS I have or may have in the future against the Releasees. I RELEASE THE RELEASEES from all liability for any loss, damage, expense or injury, including death, that I may suffer, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, INCLUDING ANY DUTY UNDER THE OCCUPIERS' LIABILITY ACT (ALBERTA).

5. Indemnity

I will HOLD HARMLESS AND INDEMNIFY THE RELEASEES from all liability for damage to property of, or injury to, any third party that results from my use of the Facility, or from the use of anyone I bring in, including minors in my care.

6. Video surveillance notice

I understand that video surveillance is in operation inside the Facility and at its entrances, for safety and security, as described in the Golf N Go Privacy Policy.

7. Photo and video consent (optional, does not affect my booking)

[ ] I consent / [ ] I do not consent to Golf N Go using photos or video taken of me at the Facility in its marketing and social media, without payment. Security camera footage is never used for marketing. I can withdraw this consent at any time by emailing ashley@golfngo.ca.

8. Minors

A parent or legal guardian must sign for anyone under 18. Anyone under 16 must be supervised by an adult (18+) at all times. VR players aged 14 to 17 must come with a parent or guardian who supervises them for the whole session. By signing on a minor's behalf, the parent or guardian accepts the terms of this agreement for themselves and confirms the minor's assumption of risk, and agrees to the indemnity in section 5 for claims by third parties.

9. General

This agreement is binding on my heirs, executors, administrators and legal representatives. It is governed by the laws of Alberta. If any part of it is found invalid, the rest stays in effect. I confirm that I have read and understood this agreement, that I am signing it voluntarily, and that it stays in effect for every visit I make.

10. Specific acknowledgements

Initial each line that applies:

  • ____ VR stations: I (or the minor I sign for) am 14 to 60, between 5 ft 1 in and 6 ft 6 in tall, and under 286 lb. I am not pregnant and have no epilepsy or seizure history, heart or lung condition, eye condition, mental health condition that VR may affect, anemia, recent surgery, limb (especially leg) condition, or other condition that rules out moderate to intense exercise. I will watch the safety video before every session and follow Meta's health and safety warnings. I will not use a VR station if any of this changes.
  • ____ VR players aged 14 to 17: I am their parent or guardian, I consent to their VR use, and I will come with them and supervise them for the whole session.
  • ____ Alcohol: I understand Golf N Go has no liquor licence. Alcohol is allowed only at a booked event with an AGLC special event licence that I have sent to Golf N Go at least 7 days before the event. Otherwise the event is alcohol-free.
  • ____ Footwear: I understand that no outdoor shoes or muddy footwear are allowed anywhere in the club, and that no cleats are allowed in the batting cage.
  • ____ Mess and cleaning: I understand that any mess left behind by me or my group may result in additional charges for cleaning or damages, charged to the card on file.
  • ____ Food and drinks: I understand that outside food and drinks are welcome in the party room and common areas, but no food or drinks are allowed on or at any station (simulator bays, VR stations, batting cage or multi-sport area) at any time, and that I may be charged for any damage caused by food or drinks.
  • ____ I will stop using any equipment right away if I feel unwell, dizzy or disoriented.
